INFORMATION NOTICE ON THE PROCESSING AND PROTECTION OF PERSONAL DATA

This Information and Clarification Form has been prepared in accordance with the Law on the Protection of Personal Data No. 6698 ("KVK Law"), which regulates the processing and transfer of personal data of individuals. Any up-to-date information shared with our company about you will be considered as "Personal Data" under Law No. 6698. The personal data mentioned below will, in any case, be processed as follows:

We hereby inform you that your personal data will be processed in accordance with the law, preserving its accuracy and up-to-date status, for specific, clear, and lawful purposes, in a manner that is relevant, limited, and proportionate, and will be stored for the period required by the relevant legislation or for the duration necessary for the purpose for which it is processed.

Our goal is to inform you in the most transparent way regarding the collection methods, purposes of processing, the persons to whom your data may be shared, the legal reasons, and your rights, in accordance with Article 10 of the KVK Law, for your satisfaction.

1. Data Controller and Representative

   In accordance with the Law on the Protection of Personal Data No. 6698 ("KVKK"), your personal data may be processed by NEC GRUP ÇETİNKAYA CONSTRUCTION CONTRACTING TOURISM INC. 2. Personal Data to be Processed and Purpose of Processing

   Your collected personal data will be processed by our company to conduct necessary activities for you to benefit from the products and services offered; to customize the products and services we offer according to your preferences, usage habits, and needs; to ensure the execution of our human resources policies; to ensure the legal and commercial security of our company and the individuals with whom we have a business relationship; to define and implement our commercial and business strategies within the scope of the conditions and purposes specified in Articles 5 and 6 of the KVK Law.

   If applicable, to access special general campaigns via mobile apps or websites, and to win other benefits/discounts within the scope of business partnerships, as well as to participate in promotions, contests, or games organized by the company. Additionally, data such as TCKN, name, surname, mobile phone number, date of birth, gender, residence address, email, and IP address may be collected and processed in connection with promotional campaigns, marketing analysis, and targeted offers on third-party environments like mobile apps, websites, or external advertisers.

   The collected data will also be used to provide customized opportunities, campaigns, and promotions through direct communication (via email, SMS, etc.), customer satisfaction analysis, managing complaints, delivering new services and offers, and ensuring compliance with legal obligations such as contracts and statutory reporting requirements.

3. Persons to Whom and Purposes for Transferring Personal Data

   NEC GRUP may transfer your personal data to its shareholders, business partners, suppliers, tax authorities, Social Security Institution, judicial authorities, and other public authorities and legal entities as permitted by relevant legislation (e.g., the Tax Procedure Law, Social Security Law, etc.), and in accordance with the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVK Law.

4. Method of Collection and Legal Basis of Personal Data

   NEC GRUP collects personal data through service providers, ensuring that you can use services smoothly, improve applications based on your preferences, and create a membership profile to provide the best service. Data may be processed on the basis of legitimate interests, with or without explicit consent where necessary, under applicable law.

   If consent has not been previously obtained, personal data will be processed based on legal obligations, and we will request your consent if it falls outside the permissible legal grounds.

5. Rights of the Data Subject Under Article 11 of Law No. 6698

   As a data subject, you can submit requests related to your rights by the methods outlined below. NEC GRUP will process your request in accordance with Article 11 of the KVK Law and respond within 30 days. If the request exceeds 5 pages, a fee of 10 TRY per additional page will be charged.

   • Learn whether your personal data is being processed;
   • Request information about the personal data being processed;
   • Understand the purpose of processing and whether the data is being used in compliance with that purpose;
   • Know the third parties to whom the data is transferred, both domestically and abroad;
   • Request correction of inaccurate or incomplete data, and have the corrections notified to third parties;
   • Request deletion or destruction of personal data when the legal grounds for processing no longer apply;
   • Object to processing that leads to a result based solely on automated processing, which has negative legal consequences for you;
   • Request compensation for damages caused by unlawful processing of personal data.

   You can submit your request to exercise the rights mentioned above in accordance with Article 13, Paragraph 1 of the Personal Data Protection Law No. 6698 and the Regulation on Procedures and Principles for Applications to the Data Controller (Official Gazette No. 30356, dated 10.03.2018), either in writing in Turkish or via the email address previously notified to NEC GRUP and registered in our system. In applications, information will only be provided about the applicant, and it will not be possible to obtain information about other family members or third parties. NEC GRUP reserves the right to verify your identity before responding.

   Depending on the nature of your request, it is necessary to provide the relevant information and documents that will allow for the identification process to be completed accurately and fully. If the requested information and documents are not provided as required, there may be delays or complications in conducting a thorough and proper investigation regarding your request. In this case, NEC GRUP reserves its legal rights. Therefore, it is important that your application includes all the necessary and requested information and documents according to the nature of your request.
